The present General Rental Conditions exclusively govern the contractual relationship between Yestogo Chianti (hereinafter referred to as the “Lessor”) and the Client holding the rental agreement (hereinafter referred to as the “Client”).

Foreword

In order to rent and drive a vehicle of the Lessor, the Client must:

  • be at least 18 years of age;

  • be in possession of a valid driving licence suitable for driving the hired vehicle;

  • have psycho-physical abilities suitable for driving motorbikes;

  • declare under their own responsibility that they are able to drive a motorbike safely.

⚠️ IMPORTANT WARNING
   Riding a scooter/Vespa on the hilly and scenic roads of Tuscany requires more experience and skill than normal city driving.
   The Vespa and other scooters available at Yestogo Chianti are FUN TO DRIVE BUT NOT SUITABLE FOR BEGINNERS e VERY EXPENSIVE TO REPAIR.

👉 NO REIMBURSEMENT WILL BE ACKNOWLEDGED if the customer books a scooter and subsequently declares or proves that he/she is unable to drive it: this situation will be considered NO-SHOW and charged as such.

👉 Reservations can be cancelled or modified up to 48 HOURS EARLIER of the date of withdrawal. Beyond that date, THE AMOUNT PAID WILL NOT BE REFUNDED UNDER ANY CIRCUMSTANCES.

1. DELIVERY AND RETURN

  • The vehicle is delivered in perfect condition, with full fuel and safety equipment.

  • By signing the contract, the Customer declares that he has checked the condition of the vehicle and accepts it as compliant.

  • The vehicle must be returned within the agreed time, at the same place of delivery and in the same condition (EXCEPT NORMAL WEAR).

  • IN THE EVENT OF A DELAY OF MORE THAN 30 MINUTES, AN EXTRA FULL DAY'S RENTAL WILL BE CHARGED.

2. LIABILITY FOR DAMAGE AND THEFT

  • THE CUSTOMER IS FULLY AND WITHOUT EXCEPTION LIABLE FOR ANY DAMAGE, LOSS OR THEFT of the vehicle, helmets or equipment.

  • In the event of theft or fire, the Customer is liable up to the commercial value of the vehicle (€ 6,500.00), unless supplementary insurance cover has been taken out.

  • Loss of keys/documents: fixed charge of € 150.

3. COSTS AND EXTRA CHARGES

The Client IRREVOCABLY AUTHORISES direct debiting of your credit card for any additional amounts, including:

a) Missing fuel → fixed penalty € 30 + missing fuel;
b) Abandonment of vehicle → € 100 + € 3/km from the Greve in Chianti site to the place of recovery;
c) Fines, violations, tolls → ALL TO BE CHARGED TO THE CUSTOMER, even if notified within 180 days;
d) Administrative detention/forfeiture → costs up to € 5,000 to be borne by the customer;
e) Tyres → punctures or damage ALWAYS borne by the customer (return with repaired wheels prohibited);
f) Unauthorised repairs → NO REFUNDS WILL BE MADE.

4. VEHICLE USE - PROHIBITIONS

The Customer undertakes NOT to use the vehicle:

  • outside Italian territory;

  • on motorways, motorways and dirt roads;

  • for races, competitions, speed trials;

  • for transport for third parties or commercial purposes;

  • under the influence of alcohol, drugs or altering substances;

  • by persons other than the customer, except for authorised and registered drivers.

🚫 SUBLETTING OR TRANSFERRING THE VEHICLE TO THIRD PARTIES IS STRICTLY PROHIBITED.

5. INSURANCE

  • All vehicles are covered by COMPULSORY MOTOR INSURANCE, which only covers damage to third parties within the legal limits and ceilings.

  • UNDER NO CIRCUMSTANCES DOES THE RC POLICY COVER DAMAGE TO THE HIRED VEHICLE, THEFT, FIRE, DAMAGE TO THE DRIVER OR IMPROPER USE.

👉 THE CUSTOMER IS OBLIGED TO CONSULT THE “DAMAGE INSURANCE” PAGE OF THE OFFICIAL YESTOGO CHIANTI WEBSITE, which forms an integral and binding part of this contract. By signing, the Client declares that he has read, understood and fully accepted the contents of the policy.

6. ACCIDENTS AND BREAKDOWNS

  • Any incident must be reported immediately to the Lessor and, where applicable, to the competent authorities.

  • In the event of a fault for which the customer is not responsible: replacement within 4 hours (if possible) or reimbursement of the remaining amount.

  • In case of damage/accident due to improper use: NO REIMBURSEMENT IS DUE AND ALL COSTS SHALL BE BORNE BY THE CUSTOMER.

7. LIMITATIONS OF THE LESSOR'S LIABILITY

The Lessor shall not be liable under any circumstances for:

  • forgotten or lost personal items;

  • delays, breakdowns or interruptions due to force majeure;

  • damage to persons or third parties resulting from the use of the vehicle.

8. PRIVACY

The Customer authorises the processing of personal data pursuant to Legislative Decree 196/2003 and GDPR 2016/679 for contractual, insurance and legal purposes.

9. JURISDICTION

Any disputes will be settled exclusively by the FLORENCE FORUM.

ACCEPTANCE CLAUSES

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Customer hereby expressly approves the clauses:
1 (delivery and redelivery), 2 (liability for damage and theft), 3 (costs and charges), 4 (use/default), 5 (insurance), 6 (accidents and breakdowns), 7 (liability limitations), 9 (place of jurisdiction).
